1. ELIGIBILITY

The Giveaway (“Sweepstakes”) is open only to legal residents of North Carolina and South Carolina who are eighteen (18) years of age or older at the time of entry.

Employees, officers, directors, agents, representatives, and immediate family members (including spouses, parents, children, siblings, and their respective spouses) of The Ordan Osborne Team, the Sponsor of the Month, and each of their respective affiliates, subsidiaries, advertising and promotion agencies, and any other entities involved in the administration of the Sweepstakes (collectively, the “Released Parties”), and any persons residing in the same household of such individuals, whether related or not, are not eligible to participate or win. Void outside North Carolina and South Carolina and where prohibited by law. All applicable federal, state, and local laws and regulations apply.

2. PROMOTION PERIOD

The Sweepstakes begins on the date and time identified in the applicable Giveaway social media post and ends on the date and time identified in the applicable Giveaway social media post (“Promotion Period”).

Entries received outside the Promotion Period are void.

3. HOW TO ENTER

During the Promotion Period, participants must complete all of the following:

• Follow The Ordan Osborne Team’s official social media account;
• Follow the designated Sponsor of the Month’s social media account identified in the Giveaway post; and
• Follow all instructions contained in the Giveaway post, including any required likes, comments, tags, or other engagement actions.

Participants who complete all required entry steps will receive one (1) entry into the Sweepstakes.

BONUS ENTRY

Participants may receive one (1) additional entry by sharing the Giveaway post to their social media feed, story, or other sharing feature available on the platform. Regardless of the number of shares, participants may receive no more than one (1) bonus entry.

Limit two (2) total entries per person during the Promotion Period. Sponsor reserves the right to verify compliance with all entry requirements. Failure to complete any required action may result in disqualification. Entries must be received before the end of the Promotion Period to be eligible. All entries become the exclusive property of Sponsor and will not be acknowledged or returned.

The use of scripts, bots, automated programs, macros, artificial means, or any other device intended to automate or circumvent the entry process is prohibited. Any entry submitted through such means shall be void. In the event of a dispute concerning the identity of an entrant, the entry will be deemed submitted by the authorized holder of the social media account used to enter. Sponsor reserves the right to require proof of identity, age, residency, and account ownership. Released Parties are not responsible for late, lost, stolen, incomplete, inaccurate, misdirected, delayed, corrupted, interrupted, garbled, or undelivered entries or communications; technical failures of any kind; network, hardware, software, internet, or platform malfunctions; human error; or any other error that may occur in connection with the Sweepstakes. Sponsor reserves the right to disqualify any entrant who tampers with the entry process, violates these Official Rules, engages in fraudulent conduct, or otherwise attempts to undermine the legitimate operation of the Sweepstakes.

4. WINNER SELECTION

One or more winners will be selected by random drawing from among all eligible entries received during the Promotion Period. The random drawing will be conducted by Sponsor or its designated representative. Sponsor’s decisions regarding all aspects of the Sweepstakes are final and binding. Odds of winning depend on the total number of eligible entries received.

5. PRIZE

The prize description, quantity, and approximate retail value (“ARV”) shall be identified in the applicable Giveaway post. No transfer, assignment, cash redemption, or substitution of a prize is permitted except by Sponsor, which reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable for any reason. All federal, state, and local taxes associated with prize acceptance and use are the sole responsibility of the winner.

6. WINNER NOTIFICATION

Potential winners will be notified through direct message, email, telephone, or other contact information associated with the winning entry. Potential winners may be required to verify eligibility, residency, and compliance with these Official Rules before receiving a prize. If a potential winner cannot be contacted, fails to respond within seven (7) days, fails to complete any required documentation, fails to satisfy eligibility requirements, or is otherwise disqualified, Sponsor may select an alternate winner.

7. PUBLICITY RELEASE

Except where prohibited by law, entry into the Sweepstakes and acceptance of a prize constitutes permission for Sponsor and its designees to use the entrant’s and winner’s name, city and state of residence, photograph, likeness, image, voice, social media username, and biographical information for advertising, publicity, promotional, trade, and other lawful purposes in any media now known or hereafter developed, worldwide and in perpetuity, without additional notice, permission, or compensation.

8. RELEASE OF LIABILITY

By entering, each entrant agrees to release, indemnify, defend, and hold harmless The Ordan Osborne Team, the Sponsor of the Month, and each of their respective affiliates, subsidiaries, officers, directors, employees, agents, representatives, successors, and assigns (collectively, the “Released Parties”) from and against any and all claims, liabilities, damages, losses, costs, expenses, actions, or causes of action arising out of or relating to participation in the Sweepstakes or the acceptance, possession, use, misuse, or redemption of any prize.

This release includes, without limitation, claims involving personal injury, death, property damage, privacy rights, publicity rights, defamation, emotional distress, or any other loss or injury.

9. SOCIAL MEDIA DISCLAIMER

This Sweepstakes is in no way sponsored, endorsed, administered by, or associated with Facebook, Instagram, X (formerly Twitter), TikTok, LinkedIn, YouTube, or any other social media platform. Participants understand that they are providing information to Sponsor and not to any social media platform. Each social media platform is fully released from any liability associated with this Sweepstakes.

10. MISCELLANEOUS

Sponsor reserves the right to conduct a background check on any potential winner. Entry into the Sweepstakes constitutes permission for Sponsor to conduct such background check, subject to any additional authorization required by applicable law. Sponsor reserves the right, in its sole discretion, to disqualify any potential winner based upon the results of a background check or a refusal to provide any authorization required by law.

Sponsor reserves the right, in its sole discretion, to modify, suspend, cancel, or terminate the Sweepstakes if fraud, technical failures, unauthorized intervention, platform outages, viruses, bugs, legal developments, or any other factor beyond Sponsor’s reasonable control impairs the integrity, administration, security, or proper operation of the Sweepstakes. In the event the Sweepstakes is terminated before its scheduled conclusion, Sponsor reserves the right to select winner(s) from among all eligible, non-suspect entries received before the termination date.

CAUTION: Any attempt by any person to deliberately damage a website, social media platform, or otherwise undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws. Sponsor reserves the right to seek damages and all other available remedies to the fullest extent permitted by law.

11. ARBITRATION

Except where prohibited by law, as a condition of participating in this Sweepstakes, entrants agree that:

• (a) Any dispute, claim, or cause of action arising out of or relating to the Sweepstakes or any prize awarded shall be resolved individually and exclusively through final and binding arbitration;
• (b) Arbitration shall be administered by the American Arbitration Association under its applicable rules;
• (c) Arbitration shall occur in Mecklenburg County, North Carolina, unless otherwise agreed by the parties;
• (d) The Federal Arbitration Act shall govern the interpretation and enforcement of this arbitration provision;
• (e) Entrants waive any right to participate in any class action, collective action, or representative proceeding.

To the fullest extent permitted by law, entrants waive any claim for punitive, incidental, consequential, special, or exemplary damages, attorneys’ fees, or multiplied damages, and agree that recovery shall be limited to actual out-of-pocket expenses directly related to participation in the Sweepstakes.

12. CHOICE OF LAW

All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, and the rights and obligations of Sponsor and entrants, shall be governed by and construed under the laws of the State of North Carolina, without regard to conflict-of-law principles.

Information collected from entrants is subject to Sponsor’s privacy policy and may be used for administering the Sweepstakes, communicating with entrants, awarding prizes, marketing purposes where permitted by law, and other lawful business purposes.
